Epikeia and the social dimension of Justice the Statute of Victims

The topicality of Epiqueya (Epikeia, from the Greek, equity) plays a central role in the current understanding of the liberal and democratic State of law. In general terms, the tension between[1] the positivism-antipositivism currents is seen as a manifestation of the opposing concerns that surround the activity of legal interpretation, especially within the framework of judicial activity. While positivism tends to privilege legal certainty, anti-positivism favors the arguments of Equity and material Justice. Antipositivism insists on refined analysis and seeks to unmask the true motives or interests of the power dynamics that underlie a legal decision. Through an analytical-descriptive methodology that involves qualitative research, with bibliographical and documentary research, this article uses the hermeneutic method and the Aristotelian Topic, investigating Restorative Justice, and aimed to demonstrate that, being balance, Equity would become the Justice of legal Justice. As a result, it analyzes PL nº 3890/90, which is being discussed in the Chamber of Deputies and aims to establish the Statute of Victims in Brazilian legislation, a social dimension of Justice in the XXI century.
