Commissive crimes by omission -Impure or promiscuous omissive crimes: practical consequences to the guarantor

The objective of this article is to present the result of a study that sought to understand the circumstances of the crime of omission, in the context of a guarantor, and to assess the way in which improper omission crimes occur, as well as to evaluate how the criminal liability of the person who has the duty of care, protection or surveillance, that is, the guarantor, in the face of its omission. The results indicated that, although there is a perception on the part of the guarantor that the guarantor is appearing as a victim, other factors stand out in that threat, such as financial and emotional dependence and even the fear of breaking the relationship, divorce when marital. Although involuntarily, a choice is made, which is configured as malice in the crime and, therefore, as a co-participant in accordance to national judgments.
