O Encarceramento em Massa na Agenda do Desenvolvimento Sustentável das Nações Unidas: Consequências para a Ação Penal no Brasil

The article assays on overcrowding prison and its presence in the United Nation’s sustainable development to the 2015-2030 period. There will be indicated the international documents and resolutions adopted by the United Nations, focusing on the abusive detention and the demands to the improvement of criminal justice system. Amongst the instruments and alternatives to face up the overcrowding prison, the criminal justice system’s improvement features prominently, especially the use of discretion or opportunity in the criminal prosecution. Therefore, the opportunity or discretion in the criminal prosecution, besides the plea bargaining and the deals in general, is a feature that precedes the discussion on the improvement of agencies and institutions involved with the criminal prosecution. In Brazil, the legislation maidenly formalized the opportunity strictly to legal colaborations on prosecutions referring to organized crime. As a strategy to face overcrowding prisons, it seems necessary to increase this regulation. Through documental analysis and bibliographic review, the essay highlights the agenda proposed by the United Nations on abusive use of detention and prisons, including how this discussion should be inserted in the Brazilian context.
