La Protección de los Derechos Laborales en los Alc de Última Generación: Modelo de EE.UU. Vs. Modelo de La UE

Resumo

El estudio se sitúa en el contexto de las últimas tendencias del panorama comercial, que se caracteriza, entre otros aspectos, por la negociación y firma de acuerdos “megarregionales”. Según la doctrina jurídica, una de las características de dichos acuerdos consiste en su ámbito de aplicación muy amplio, que incluye los compromisos en materia de inversiones, medioambiente y derechos laborales.

El presente trabajo se centra en el análisis comparado de los capítulos laborales de los dos acuerdos de libre comercio (ALC) de “última generación”: el Acuerdo Transpacífico de Cooperación Económica (TTP), cuya entrada en vigor ha quedado paralizada debido al cambio de rumbo en la política comercial de su mayor socio, los Estados Unidos de América (EE.UU), y el Acuerdo Económico y Comercial Global entre la Unión Europea y Canadá (CETA), aprobado recientemente por el Parlamento Europeo.

No obstante, y desde el punto de vista teórico, parece interesante contribuir al debate sobre los modelos actuales de las cláusulas sociales, llevando a cabo la comparación de dos planteamientos distintos, promovidos, respectivamente, por EE.UU., en el marco del TPP, y por la Unión Europea (EU), en el marco del CETA.

En este sentido, se compara el contenido de la cláusula social, a saber, los derechos laborales que se protegen, y los mecanismos de control para asegurar la protección efectiva de estos derechos en los dos sistemas normativos.
