"Calabresi’s appealing to Congress": The search for a Federal Supreme Court more minmalist

This article investigates the possibility that the decision-making technique called “Appeal to Congress”, if used by the Federal Supreme Court (STF), can stimulate a “minimalist” interpretative posture, in the sense that Cass Sunstein attributes to this expression. To this end, it begins by presenting Cass Sunstein's Judicial Minimalism as a jurisdictional posture capable of promoting deliberative democracy, especially in the context of judicial review. Next, some cases will be analyzed in which the “appeal to the legislator” is applied by the German Federal Constitutional Court, as a way to extract some working hypotheses. Finally, it will be demonstrated how the “Appel to Congress” could be used by the “minimalist” STF, thus reducing the excesses of “judicialization of politics”
