Las Empresas y la Protección de los Derechos Humanos en el Sistema del Consejo de Europa

This study establishes as objective the analysis of the position of companies and, especially, multinational corporations, among the subjects and actors of International Law. In order to describe this position, reference has been made to the four elements of international legal personality, namely: active legitimacy, passive legitimacy, privileges and immunities at the international level and participation in the law creation process. Particular attention has been given to the study of the capacity of companies to possess international rights and obligations and to maintain these rights by brining international claims and to be responsible for the breach of their obligations within the Council of Europe system of human rights protection.
