Public contracting has been considered a fundamental issue in the development and evolution of supranational Administrative Law, in the complete harmonization of Community law and in its application by the Member States. The numerous normative mutations that have suffered its regulation are subject of analysis in the present project, being the fundamental purpose that brings cause of this investigation, the study of the Judgment of the CJEU of March 21, 2019 (C-465/17) a From which, we proceed to the development of a novel and harmonized concept for non-profit organizations and a correct interpretation of the application of Article 10, letter h of Directive 24/2014 / EU.
